WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT  Franklin Farm Rescue & The Sanctuary Location: 16943-45 Platinum place Lakeside CA 92040 PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS. 1. Assumption of Risk I, the undersigned, acknowledge that my participation in activities at Franklin Farm Animal Rescue and The Sanctuary (collectively, "the Sanctuary") involves inherent risks, including but not limited to interactions with animals, outdoor terrain, and physical activities. I understand that animals, even those that are well-trained or domesticated, may behave unpredictably and that these activities carry risks of injury, illness, or property damage. I voluntarily assume all risks associated with my participation.  2. Waiver and Release of Liability To the fullest extent permitted by California law, I hereby release, waive, discharge, and hold harmless Franklin Farm Animal Rescue, The Sanctuary, its owners, employees, volunteers, contractors, affiliates, and representatives (collectively, "Released Parties") from any and all claims, liabilities, damages, or causes of action, whether known or unknown, arising out of or related to my participation in activities at the Sanctuary, including but not limited to personal injury, property damage, or death, regardless of whether caused by the negligence of the Released Parties.  3. Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including legal fees) arising out of my actions while on the premises or participating in any activities related to the Sanctuary.  4. Medical Treatment Authorization I authorize the Sanctuary to provide first aid and, if necessary, seek emergency medical treatment on my behalf. I understand that I am responsible for any medical costs incurred.  5. Media Release I grant the Sanctuary permission to use photographs, videos, or other media taken of me during my visit for promotional, educational, or other lawful purposes without compensation.  6. Acknowledgment of California Civil Code § 1542 I expressly waive all rights under California Civil Code § 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."  7. Minor Participants If signing on behalf of a minor (under 18), I certify that I am the parent or legal guardian and accept full responsibility for the minor’s participation.  8. Governing Law & Severability This agreement shall be governed by the laws of the State of California. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
